Exempt Development

Exempt Development is development that does not require Council Approval. To establish if your development is exempt from Development approval you can check the NSW Legislation website - when looking at the Exempt and Complying Code SEPP you must know what your land is zoned, if the lot is Flood or Bushfire Prone land if the lot is located within a Biodiversity area or within 18km of the Observatory.

Some minor building renovations or works don’t need any planning or building approval. This is called exempt development. Exempt development is very low impact development that can be done for certain residential, commercial and industrial properties.

A few examples of development that can be exempt development are: decks, garden sheds, carports, fences, repairing a window or painting a house. More information is available in the Understanding exempt development fact sheet.

Further information on exempt development can be found on the Planning Website.
