Three Rivers Regional Retirement Community

Warrumbungle Shire Council continues to work through legal matters surrounding the Three Rivers Regional Retirement Community Project in Dunedoo following the termination of the contractor Boulus Constructions in August 2018. 

In response to Council terminating the contract, the contractor instigated legal action, with the legal process continuing to progress through the NSW Supreme Court. 

In early 2021, the Court instructed Boulus Constructions and Council to undertake mediation in an attempt to resolve the matters between the two parties. 

After a number of delays due to COVID, the mediation was eventually undertaken via video link during October 2021; unfortunately, no resolution could be agreed upon between the two parties. 

With mediation unsuccessful, the matter is scheduled to continue through the Supreme Court process with a hearing to be held sometime during mid-2022. 

Over recent times, the project site has been subject to break-ins with a number of windows, doors, door frames and security cameras stolen. These break-ins are now subject to Police investigations with some solid leads. 

With the continuing legal processes surrounding the project, Council has been unable to move forward with the site, and acknowledges the visual impacts the project is creating for the community of Dunedoo. To assist softening the visual impacts, Council is proposing to erect fencing to screen the site from view and is in the process of seeking quotes for exterior fencing. 

Council continues to hold regular discussions with both State and Federal Governments on the remaining project monies. 

It is most disappointing for Council and the local Dunedoo community that this matter has not yet been resolved.
