Dwelling Entitlement

For most people buying a property is a very significant decision and it is particularly important to ensure that purchasers can use the property the way in which they wish to use it, especially to find out whether a dwelling house can be built on the land.‚Äč

“The best way to find out whether a dwelling house or dual occupancy can be approved on a piece of land is to undertake a dwelling entitlement search with Council,” said Warrumbungle Shire Council Mayor, Councillor Denis Todd. 

A dwelling entitlement refers to the ability of Council to approve a dwelling or dual occupancy on a certain property. Advice relating to dwelling entitlements within the Warrumbungle Shire will detail whether a dwelling is permissible within the property’s zone, and if the property meets the minimum development standards established under the Warrumbungle Local Environmental Plan 2013 (LEP).

On 2 October 2015, there was an amendment to Clause 4.2A - Erection of Dual Occupancies and Dwelling Houses on land in Zone RU1 – Primary Production under the Warrumbungle Local Environmental Plan 2013 (WLEP2013). This was a sunset clause and is set to expire on 2 October 2020.

“If the land was previously zoned 1 (b) Rural – General or 1 (c) Rural – Small Holdings where a dwelling house or dual occupancy could have been lawfully erected under the provisions of the former Coonabarabran LEP1990, then this dwelling entitlement expiry date may affect you,” Cr Todd explained.

“After 2 October 2020 there may be no further entitlement to erect a dwelling or dual occupancy on your property,” said Cr Todd.
